These General Terms and Conditions of Sale and/or Service apply to the offer and sale of the products and/or services offered by lifexpan.eu and described on our website.

These General Terms and Conditions of Sale define the applicable conditions of the distance contract for products purchased on our website, governed by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, and by EU Directive 2023/2673 on the protection of consumers in distance contracts.

For any dispute regarding products, payments, shipping, orders, or purchases, you can contact our customer service directly.

By requesting and receiving the products and/or services offered on our website, the user assumes, without any reservation, the obligations established in these General Contracting Conditions, acquiring the status of a registered user of our website (hereinafter, the USER or CUSTOMER). Therefore, before completing the purchase process of a product and/or service on our website, please carefully read the content of these General Conditions, the applicable ones being those in force on the day the product and/or service is ordered, which will provide you with the necessary information on the procedure to follow to achieve the correct purchase of our products and services.

Following all the steps until validating the order on our website and, where applicable, the chosen method of payment, expresses the full and unreserved adherence of the USER to each and every one of the General Conditions published at the time the User accesses this website.

The acquisition of our products and services is likewise subject to the General Conditions of Use of our website, which are found in the legal notice, and will have the character of complementary regulations regarding what is not provided for in these General Conditions and in everything that does not oppose them.

No particular condition can, unless formally accepted in writing by lifexpan.eu, prevail over these General Conditions. ENTRY INTO FORCE

These General Conditions will enter into force at the moment the USER accesses this website and provides their consent to contract the service and/or product. At that moment, the User accepts and adheres completely to all the general conditions included in this text.

PURCHASES ON LIFEXPAN.EU

Access to sales on lifexpan.eu is reserved exclusively for users over 18 years of age.

The customer acknowledges that, by accepting the terms of service, they hold lifexpan.eu harmless from any liability arising from the purchase of the product if this violates the law of the country where the product is sold. The customer is also obliged to inform themselves whether the law or regulations of their country permit or authorize the purchase of the products offered for sale by lifexpan.eu, considering them legal. Therefore, the customer expressly indemnifies lifexpan.eu for any violation of the law regarding the previous point, assuming all responsibility.

All lifexpan.eu products are purchased and sold only within the territory of the European Union.

lifexpan.eu reserves the right to modify the special conditions of these services, previously informing the USER.

REQUEST FOR SERVICE, PRODUCT AND RIGHT OF WITHDRAWAL

The fact of making a purchase on the website implies the prior knowledge and express, irrevocable, full and unreserved acceptance of the USER of these general conditions of sale. The request made in the name or on behalf of the USER will be considered as made by themselves. To conclude the purchase contract for one or more products on lifexpan.eu, the user must complete an order form in electronic format and send it to lifexpan.eu by electronic means, following the instructions that appear on the website and that accompany the different stages of the purchase.

The user may correct any data error before validating the order, following the instructions indicated on lifexpan.eu that accompany the different stages of the purchase.

Once the purchase is made, lifexpan.eu will send an order confirmation to the user. This confirmation will contain a summary of the General Conditions of Sale and the special conditions applicable to the contract, the characteristics of the purchased product, a detailed indication of the price, information on the right of withdrawal, shipping costs and any additional cost, as well as the contacts of Customer Service.

Specific clauses of the EU Right of Withdrawal:

In accordance with current European Union regulations, the CUSTOMER has a right of withdrawal of 14 calendar days from the physical receipt of the product to terminate the contract without the need for justification.

Health and Hygiene Exception: By virtue of Article 16.e) of Directive 2011/83/EU, the right of withdrawal will not be applicable under any circumstances to goods that have been unsealed, opened or manipulated after delivery for reasons of health protection or hygiene. As our products are food supplements and nutritional items, any alteration of the thermal, plastic or internal security seal of the container completely invalidates the right of return. Products must be returned intact, in their original packaging and in perfect condition for resale.
Return costs: The direct costs of returning the product will be borne entirely by the CUSTOMER. The return shipping is carried out under the exclusive responsibility of the CUSTOMER, recommending a certified delivery method with a tracking number.
Automated Withdrawal Mechanism: In compliance with the law, the CUSTOMER may exercise this right preferably by using the withdrawal button or self-service flow enabled in their user panel of the online store, or by sending an unequivocal statement through our support channels.
Refund Period: The refund will be made using the same payment method used in the initial purchase, within a maximum period of 14 calendar days from the moment we receive the merchandise back. If the return is total, the refund will include the initial standard shipping costs of the purchase; if the return is partial, only the cost of the compliant returned products will be refunded. In accordance with current legislation, lifexpan.eu reserves the right to withhold the refund until the goods have been physically received or proof of their return has been provided.

The language for the conclusion of this contract is Spanish; however, our customer service can assist the User in Spanish, French and English.

PRICE

The price of each of the products will be clearly determined on the page on which it is displayed and the one published at the time the order is placed will apply.

The USER who acquires any of the services and/or products offered by the website must pay the corresponding price through an electronic payment or a bank transfer in favor of lifexpan.eu. The USER may choose any of these forms of payment by indicating it on the order form.

Applicable taxes that accrue from contracting the services and/or products will be understood to be included in the price of the services displayed, unless otherwise stated. lifexpan.eu will bear the taxes derived from the order, such as Value Added Tax at the percentage rate in force at the time of its accrual.

ORDER – PRODUCT INFORMATION

lifexpan.eu will process the order and send the purchased product once it has received the total amount due of the purchase price, shipping costs, if applicable, and any other previously indicated additional cost.

The products offered by lifexpan.eu are always accompanied by a product sheet, with its characteristics and images, trying always to display the information as faithfully as possible. However, colors and/or size may differ due to the computer configuration used by each user. Therefore, the images must be considered indicative and, for the purposes of the purchase contract, the description of the product indicated in each order sent electronically by the user will prevail.

DECLARATIONS AND WARRANTIES OF THE USER

As a USER, you expressly declare and accept:

That you are not a reseller or wholesaler, or that you do not intend to purchase the products for the purpose of subsequently reselling them without the express written authorization of the brand.

That, by accepting our general conditions of sale, you discharge lifexpan.eu from any liability derived from the purchase of our products if this is contrary to the law of the country from which you acquire said product. Likewise, as a USER, you are obliged to be aware of the laws and/or regulations of the country from which you acquire our products and, specifically, whether you are authorized to purchase the products displayed by lifexpan.eu. Therefore, as a USER, you assume all responsibility for your purchases on the website and exempt lifexpan.eu from any violation of the law in the country from which you access and contract our services and/or products.

That the products offered for sale on lifexpan.eu are food supplements, supplements and wellness products intended for the personal use and consumption of the end customer, always following the recommended indications for use.

That you do not have any ongoing legal dispute contravening the general conditions of sale of lifexpan.eu, nor have you been involved in fraud of any kind, especially fraud with virtual payments, credit cards, identity theft and/or documentary forgery.

That the USER is the only one who provides or decides the information indicated in their registration and, therefore, is solely responsible for the authenticity and veracity of said information and for any damage or prejudice that may derive from it, facing lifexpan.eu and third parties.

lifexpan.eu reserves the right to reject, at its discretion, any reservation request if it finds that the USER fails to comply with any of the above statements, violates the rights and interests of lifexpan.eu or considers them inappropriate, without prejudice to initiating any legal actions that may assist it.

PROTECTION OF PERSONAL DATA AND COOKIES

In compliance with the General Data Protection Regulation of the EU (GDPR 2016/679) and the Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), lifexpan.eu informs you that all personal data provided during the registration and purchase process will be incorporated into our processing activities with the exclusive purpose of managing your orders, processing your shipments and, provided there is express consent, sending you informative or commercial communications about health updates and LifeXpan® products.

Unless specifically established otherwise, it will be considered necessary to complete all the data required in the forms. In the case of not providing all the data deemed necessary, lifexpan.eu may, depending on the case, not process the specific request made.

You must fill out the forms with true, accurate, complete and updated data, responding for any damages or losses that could be caused due to defective completion of the forms with false, inaccurate, incomplete or outdated data.

lifexpan.eu has adopted the security levels for the protection of personal data required by current data protection legislation, installing the necessary technical and organizational measures to prevent loss, misuse, alteration, unauthorized access and other possible risks.

The user or person representing them may exercise at any time their rights of access, rectification, erasure (oblivion), restriction of processing, objection and portability in accordance with the provisions of the applicable regulations, by addressing a written communication to lifexpan.eu through the contact page proving the identity of the data subject.

RESOLUTION AND TERMINATION

This contract will terminate when both parties comply with the obligations to which they commit themselves in it or when it is resolved by either of them if any of the causes provided for resolution concur.

This contract may be resolved by either party if the counterparty seriously breaches any of the obligations established in the contract, without prejudice to the eventual claim for damages, including loss of profit, which could correspond to such breach.

NOTIFICATIONS AND NOTICES

Any notification or notice by either party must be sent by any method that reasonably allows believing that the information has arrived safely, preferably by email or through the internal notification tools of the e-commerce platform.

RELATIONSHIP WITH OTHER CONTRACTS

The relationship between the User or buyer and lifexpan.eu is governed by these General Conditions.

Without prejudice to the foregoing, for the acquisition of any specific service and/or product, any other General or Specific Conditions for that service may be attached or submitted for the USER's approval. In such a case, the aforementioned specific General Conditions will apply preferentially to the relationship between the USER and lifexpan.eu and only in a supplementary manner and in what does not contradict them will these General Conditions apply.

INVALIDITY AND PARTIAL NULLITY

If any of the provisions of this contract were considered null or inapplicable (in whole or in part) by any competent court, tribunal or administrative body, such nullity or inapplicability will not affect the other provisions of the contract, which will retain their full force.

APPLICABLE LAW AND COMPETENT JURISDICTION

These general conditions of sale will be governed, both for their interpretation and execution, by Spanish law and the regulatory framework of the European Union.

The courts of the city of Barcelona will be the only competent ones in the event of a dispute of any nature or problem derived from the formalization, execution or interpretation of any sales contract concluded between lifexpan.eu and a customer, provided that the latter does not have the status of consumer, in accordance with the definition contained in the current law for the defense of consumers and users.

The User declares to have read, known and accepted these conditions in their full extent.
